These terms govern your use of the Nomar website and any consulting engagement you book through it.

The service

Nomar provides a fixed-fee operational diagnostic and related consulting. The diagnostic is a written analysis and recommendation; it is advisory and does not guarantee any specific business outcome.

Engagements and fees

Engagement scope and fees are confirmed in writing before work begins. The diagnostic is a fixed-fee engagement as described on this site. Payment terms are stated at the time of booking.

Your responsibilities

You agree to provide accurate information and reasonable access to the people and materials needed to complete the diagnostic.

Intellectual property

Methods, templates, and frameworks Nomar uses remain Nomar's property. The written diagnostic prepared for you is yours to use within your organization.

No warranty; limitation of liability

The website and the diagnostic are provided on an "as is" basis without warranties of any kind. To the maximum extent permitted by law, Nomar's total liability arising from an engagement is limited to the fees paid for that engagement. Nomar is not liable for indirect or consequential damages.

Confidentiality

Each party will protect the other's non-public information shared during an engagement and use it only to perform the work.

Governing law

These terms are governed by the laws of the Province of Ontario and the applicable laws of Canada. The courts of Ontario have jurisdiction over any dispute.
